Our democracy will be sick?

It seems that our democratic system is sick! As has been the poor quality of elected representatives that make up a so-called "committee of inquiry," that every day gives a depressing spectacle of this quality, disrespect for one another using language "obscene" lack of legal norms, lack of rules and management standards, lack of standards for negotiation - brings in citizens a sense of shame and discredit political! These are the representatives elected by the citizens?

As a citizen I am bothered with this throw sand into the eyes of others, is that this episode contrasts with other cases in which the Assembly of the Republic has been called the "right to remain silent" (BPN (Dr Oliveiar and Costa), BPN (Dr Joseph Capricious, Ex-JAE (General Garcia dos Santos, has met the deputies at the time the Act) - Today is considered disobedience qualified yesterday in these same situations was considered a right of the accused. Honourable Members should know that a defendant in criminal proceedings has the right not to testify in that case. It is understood that this right extends to silence any other proceedings (civil, administrative, disciplinary, etc.) that have to do with the matter under investigation or that the defendant is accused in criminal proceedings . That's why it would still be interesting reason or reasons that led to one last year and the parties changed their minds. What then was understandable and acceptable exercise of a deponent refuses to answer questions because this the constitutional right of all defendants today is a "crime of disobedience"?

Será que o nosso regime democrático não está doente?

Tudo leva a crer que o nosso regime democrático está doente! Como bem demonstra a falta de qualidade dos “deputados” que compõe um dita “comissão de inquérito”, que todos os dias dá um espectáculo deprimente dessa qualidade, desrespeito uns pelos outros com utilização de linguagem "obscena" desconhecimento de normas legais, desconhecimento de regras e normas de gestão, desconhecimento de normas negociais – provoca nos cidadãos um sentimento de vergonha e descrédito politico! São estes os representantes eleitos pelo voto dos cidadãos?
Como cidadão fico Incomodado com este atirar de areia para os olhos dos outros, é que este episódio contrasta com outros casos em que já na Assembleia da Republica foi invocado o “direito de não falar”, ( BPN (Dr Oliveiar e Costa), BPN (Dr José Caprichoso, Ex-JAE (General Garcia dos Santos, tendo os deputados nessa altura cumprido a Lei) – Hoje é considerado crime de desobediência qualificado, ontem nestas mesmas situações foi considerado um direito do arguido. Ao contrário do que se passou, os vários partidos representados na comissão incluindo os do PCP,PSD e do CDS-PP, aceitaram a justificação dada para a recusa em responder às perguntas e que era à semelhança da dada por Rui Pedro Soares, sendo arguido num processo ser seu direito recolher-se ao silêncio no exercício de um direito constitucional.
Segundo julgo saber o senhor Dr. Rui Pedro Soares foi constituído arguido de um processo tendente aos mesmos factos, que se discutem nesta comissão de inquérito. Ora, se em processo penal o arguido tem direito ao silêncio não é possível que não o tenha onde quer que seja. Quer dizer, no processo ficava calado e nesta dita comissão era obrigado a falar. No processo não se incriminaria e na comissão teria, eventualmente, de se incriminar . No fundo, o pesou dois valores: de um lado, o risco de ser acusado de desobediência; de outro, o direito à defesa. E entre os dois, "predomina o direito de defesa, Um arguido em processo crime tem o direito de não prestar declarações nesse processo. Tem-se entendido que esse direito ao silêncio abrange quaisquer outros processos (civis, administrativos, disciplinares, etc) que tenham a ver com a matéria em investigação ou de que o arguido é acusado no processo crime., não põr em risco a gestão normal de uma empresa de prestigio e prestigiada no nosso País? Os senhores deputados deviam saber que um arguido em processo crime tem o direito de não prestar declarações nesse processo. Tem-se entendido que esse direito ao silêncio abrange quaisquer outros processos (civis, administrativos, disciplinares, etc) que tenham a ver com a matéria em investigação ou de que o arguido é acusado no processo crime. É por isso que não deixaria de ser interessante a razão ou razões que levaram a que um ano passado e os partidos mudaram de opinião. Aquilo que na altura era o exercício compreensível e aceitável de um depoente se recusar a responder a perguntas por ser esse o direito constitucional de todos os arguidos, hoje constitui um "crime de desobediência"?
